Terms of Service

1. Acceptance of Terms

By accessing or using Kenvii, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the app.

2. Description of Service

Kenvii is a family safety application that provides:

• Real-time location sharing between family and Orbit members.
• Emergency SOS alerts.
• Orbit (group) and event management.
• Location history, Privacy Zones, and Temporary Sharing features.

3. User Accounts

To use Kenvii, you must:

• Create an account with accurate information.
• Be at least 13 years old (or have parental consent).
• Provide your accurate date of birth for age verification.
• Keep your account credentials secure.
• Notify us of any unauthorized use at support@kenvii.com.

You are responsible for all activities under your account. Providing false age information, or creating multiple accounts to evade restrictions, is a violation of these Terms.

4. Acceptable Use

You agree NOT to use Kenvii to:

• Track anyone without their knowledge or consent.
• Stalk, harass, or harm others.
• Violate any laws or regulations.
• Share another person's location without their permission.
• Falsify your location using mock-location tools, GPS-spoofing software, or emulated devices. The app may reject or flag uploads it determines to be non-genuine.
• Trigger SOS alerts as a prank, joke, test, or drill. The SOS feature is for genuine emergencies only. Misuse may result in account termination and, in some jurisdictions, legal liability for emergency-services interference.
• Interfere with the app's operation, security, or rate limits.
• Create fake accounts or impersonate others.
• Attempt to reverse-engineer, decompile, or extract source code from the app.
• Use Kenvii to collect data about other users for commercial purposes.

5. Consent for Location Sharing

By using Kenvii, you acknowledge that location sharing requires explicit consent from all parties. You must only connect with family and Orbit members who have voluntarily agreed to share their location with you. Unauthorized tracking or surveillance is strictly prohibited and may result in account termination and legal action.

Privacy Zones

• You may designate Places (like Home or Work) as Privacy Zones.
• When at a Privacy Zone, your exact location is masked — others see only a label such as “at Home”.
• Privacy Zones provide location privacy but are not a guarantee of anonymity.

Temporary Location Sharing

• You can share location for limited durations (1 hour, 4 hours, 1 day, 1 week).
• Temporary shares automatically expire at the specified time.
• You can stop sharing at any time before expiration.

5a. Users Under 18

Kenvii provides enhanced privacy protections for users under 18:

• Location sharing defaults to OFF and must be explicitly enabled.
• Default sharing duration is 1 hour (temporary) rather than permanent.
• Privacy Zone features are automatically enabled.
• An enhanced privacy badge is displayed on minor accounts.

Parents and guardians should review these settings with minor users.

6. SOS and Emergency Features

Important notes about the SOS feature:

• SOS alerts depend on network connectivity, your device's battery, and your contacts' notification settings. Alerts may be delayed or fail to deliver.
• Triggering SOS will share your location with your emergency contacts even if Privacy Mode is on — this override applies until you cancel the SOS alert.
• We do not guarantee that all alerts will be received, read, or acted upon.
• Kenvii does not contact emergency services on your behalf. You remain responsible for escalating to official services when necessary.
• Triggering SOS as a prank, false alarm, or test violates these Terms (see Section 4) and may result in account termination.

7. User-Generated Content

When you post content in Kenvii — messages, place notes, event descriptions, Orbit names, profile information — you retain ownership of that content. You grant Kenvii a non-exclusive, royalty-free, worldwide license to store, display, and transmit that content solely for the purpose of operating the service (for example, showing your message to other members of your Orbit).

This license ends when you delete the content or your account, subject to the backup retention periods described in our Privacy Policy.

You are responsible for the content you post. Content that violates these Terms — including unlawful, harassing, deceptive, or abusive content — may be removed, and may result in account termination.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.

9. Intellectual Property

All content, features, and functionality of Kenvii — including the name, logo, design, and code — are owned by us or our licensors and are protected by intellectual property laws. Except as needed to use the app normally, you may not copy, modify, distribute, or reverse-engineer any part of Kenvii without permission.

This section does not apply to content you post (see Section 7, User-Generated Content).

10. Payment Terms

Kenvii currently offers a free tier and may offer paid subscription tiers (Gold, Platinum) with extended location history and other features. If you subscribe to a paid tier:

• Billing is handled by Apple App Store or Google Play, subject to their respective terms and refund policies.
• Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.
• You can cancel anytime via your App Store or Play Store subscription settings.
• Paid features remain available until the end of the current billing period if you cancel.
• Refund requests are handled by the app store where you purchased, not by Kenvii directly.

10a. Advertising

Kenvii is supported in part by advertising. The free tier displays ads served by Google AdMob within the app. Paid tiers may offer an ad-free experience; see the app's subscription page for current benefits.

By using the free tier, you agree to the display of advertising content. Clicking on ads takes you to third-party websites or app-store listings governed by the advertiser's own terms; we are not responsible for those destinations.

11. Disclaimers

Kenvii is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee:

• Continuous, uninterrupted, or error-free service.
• Accuracy, precision, or real-time delivery of location data.
• That the app will meet your specific requirements.
• That defects will be corrected.
• That SOS alerts will be received, read, or acted upon.

12. Limitation of Liability

To the maximum extent permitted by law, Kenvii and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, personal injury, property damage, or emotional distress — resulting from your use of Kenvii, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms shall not exceed the greater of USD $100 or the amount you paid us in the 12 months before the claim arose.

12a. Indemnification

You agree to indemnify and hold harmless Kenvii and its operators from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law or the rights of a third party, including the right to privacy; or (d) content you post, transmit, or share through the Service. We reserve the right to assume the exclusive defense of any matter subject to this indemnification at your expense, in which case you agree to cooperate with our defense of that matter.

13. Termination

We may suspend or terminate your account for violations of these Terms, abusive behavior, or activity that puts the safety or integrity of the service at risk. You may delete your account at any time via Settings → Delete Account.

14. Changes to Terms

We may modify these Terms at any time. For material changes, we will notify you via in-app banner or email at least 7 days before the change takes effect. Continued use after the change constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of Kenvii shall be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
